WAIVER OF LIABILITY

In this document, 'Kritee Kritee' refers to the individual also known as 'Kritee Kanko’.

VOLUNTARY PARTICIPATION

1. I, the undersigned, confirm that I have voluntarily chosen to participate with Kritee Kanko in coaching, mentoring, counseling, receiving guidance, and other activities (collectively, the "Program") provided by her, Boundless in Motion or other organizations she is associated with.

The Spiritual mentoring program might include, but is not limited to, receiving individual or group counseling for personal or spiritual development while engaging in specific activities, which may include contemplation of archetypal stories (Zen koans), nature walks, silent or guided meditation, mindfulness of sensations, emotions and thoughts, journaling, healing rituals like yoga, rhythmic abdominal breathing and physical exercises, dietary practices and artistic activities.

I understand that my participation in these activities is voluntary and that I am aware of the nature of these activities.

ASSUMPTION OF RISK

2. I am fully aware that participation in the Program may involve physical, mental, and emotional exertion and risks, which may include, but are not limited to, meditation, yoga, and other activities. I understand that participation in this Program may cause unusual psychological, spiritual, and/or physical states of mind and body. I am voluntarily participating in these activities with full knowledge of the risks involved, and hereby agree to accept any and all risks of “harm” that may result from these activities. 

The practices and guidance received in any course, online or in-person session, teaching, or correspondence by Kritee Kanko or the Organization are not meant to be or intended to treat or diagnose any condition. I understand that the guidance and practices offered by the Organization are not a substitute for professional medical advice, diagnosis, or treatment, and do not purport to cure, treat, or prevent any medical, psychological, or emotional conditions. I also acknowledge that it is my responsibility to consult with a healthcare provider prior to and regarding my participation in the Program, and to seek immediate medical attention if any health concerns arise.

RELEASE

3. COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

TO THE FULLEST EXTENT PERMITTED BY LAW, I, on behalf of myself and my heirs, assigns, personal representatives, and next of kin, HEREBY UNCONDITIONALLY AND FOREVER RELEASE, DISCHARGE, AND HOLD HARMLESS Kritee Kritee (also known as Kanko), her affiliated organizations (collectively, the "Organization"), their officers, officials, agents, employees, and volunteers from any and all liability, claims, demands, actions, rights of actions, or legal proceedings of whatever kind, whether in law or equity, whether known or unknown, arising out of or in any way connected with my participation in the Program.

I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue, or attach the property of Kritee Kritee (also known as Kanko), its affiliates, employees, agents or volunteers or any of its affiliated organizations for injury or damage resulting from acts, howsoever caused, by any employee, agent, or contractor of these organizations, or any of their affiliated organizations.

This release includes, without limitation, any claims for bodily injury, death, or property damage that are caused by the negligence of any of the aforementioned parties or otherwise, to the maximum extent allowed by law. I fully understand and acknowledge that by signing this document, I am assuming full responsibility for any and all risks of death, bodily injury, or property damage suffered by me while participating in the Program.

FURTHERMORE, I HEREBY INDEMNIFY AND HOLD HARMLESS the Organization, their officers, officials, agents, employees, and volunteers against any losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable legal fees, fees, and the costs of enforcing any right to indemnification under this Agreement and the cost of pursuing any insurance providers, arising out or resulting from my participation in the Program.

NO REFUNDS, NO EXCEPTIONS POLICY

4. Upon registering or paying for any coaching session, guidance, teachings or retreat, I understand that my payment is non-refundable and non-transferable, unless otherwise noted in writing. I recognize that I am not considered officially registered for a session until my payment has been received 72 hours (3 days) before a session. There are no exceptions to this Policy, whether or not you have started the Program, have accessed any files or documents, or if you have completed the Program. There is no fee for cancellation before 48 hours. If you cancel within 48 hours of the 'individual' session, you will pay 50% of your registration fee. For cancellation within 24 hours, you will pay the full amount for the session.

CONFIDENTIALITY AND PRIVACY OF MATERIALS

5. I agree not to disclose, reproduce, sell, distribute, or otherwise provide access to any materials or oral teachings I receive from the Organization to any third party without the express written permission of the Organization. I understand that this counseling, guidance or mentoring requires experience, and I take responsibility for determining my own suitability for this teaching. My registration in the mentoring program is considered an acknowledgement that I have read, understood, and agreed to abide by these Terms & Conditions.

SEVERABILITY

6. If any provision of this waiver and release is held unenforceable or invalid under any law, such unenforceability or invalidity shall not affect the enforceability or validity of any other provision and such unenforceable or invalid provision shall be severed from the remainder of this waiver and release. The remainder shall be enforced as fully as possible.

JURISDICTION AND GOVERNING LAW

7. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of, or related to, this Agreement or the Program shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado in each case located in the city of Boulder and County of Boulder, and each party consents to the jurisdiction of such courts in any such suit, action, or proceeding.

KNOWING AND VOLUNTARY EXECUTION

6. By signing below, I acknowledge and agree that I have fully read, understood, and agree to comply with these Terms & Conditions. "I hereby confirm that I have read this document in its entirety, understand its terms, and I am signing it freely and voluntarily." I am aware that this is a release of liability and a contract between myself and Kritee Kritee (also known as Kanko), the Organization and/or her affiliated organizations and I sign it of my own free will. I acknowledge that Kritee Kritee and Kritee Kanko refer to the same individual.

I confirm that I am of legal age in my jurisdiction, and I have read, understood, and accepted the above waiver, release, and indemnification.
